
In Portugal, the purchase of devices by the institutions of the National Health Service (NHS), must comply with requirements in accordance with applicable law. Often it is necessary to ask the manufacturer or distributor of the device documents attesting to compliance with the law. The labeling and package leaflet must be written in Portuguese. The purpose and manufacturer of the device must be properly identified.
The Order no. 15247/2004 of the Office of the Minister of June 30, 2004, states that the departments and agencies under the Ministry of Health or under their tutelage in public tenders require proof of payment of marketing rate (0.4 %) through a declaration issued by Infarmed.
The Order No. 15371/2012 states that the health services of NHS only may acquire medical devices coded, in the case of belonging to a group of devices already coded by Infarmed.
In Portugal, the purchase of devices is regulated by the Public Contract Code (PCC) Decree-Law n. º 18/2008 of 29 January. The procedures used are both the Direct Agreement, as the Tender, or the Restricted by prior qualification.
